Waiver and Release of Liability:

By purchasing a ticket and/or entering The Ice Palace premises, all guests acknowledge and agree to the following:

Acknowledgment of Risks: I, the purchaser or tickets as well as the party of people I represent, acknowledge that participating in activities at or in the vicinity of the Ice Palace (the “Event”) involves inherent risks, including but not limited to slips, falls, collisions with other participants, equipment malfunctions, exposure to extreme cold, and injuries related to icy surfaces. I understand that these risks may occur whether due to my own actions or the actions of others. I VOLUNTARILY AND FREELY CHOOSE TO PARTICIPATE IN THE EVENT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, ASSOCIATED WITH MY PARTICIPATION, INCLUDING THE RISK OF NEGLIGENCE BY THE ICE PALACE.

Waiver and Release: IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE EVENT, I HEREBY, ON BEHALF OF MYSELF AND MY HERIS, ASSIGNS, PERSONAL REPRESENTATIVE, AND NEXT OF KIN, HEREBY RELEASE, WAIVE, AND DISCHARGE THE ICE PALACE, EVENT ORGANIZERS, SPONSORS, VOLUNTEERS, AFFILIATES, AS WELL AS THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY FOR ANY INJURY, ILLNESS, DEATH LOSS, OR DAMAGE THAT I MAY SUFFER AS A RESULT OF MY PARTICIPATION, EVEN IF SUCH INJURY, ILLNESS, DEATH, LOSS, OR DAMAGE IS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

Indemnification: I agree to indemnify and hold harmless the Released Parties, from any and all claims, actions, suits, procedures, costs, expenses, damages, liabilities, including attorney’s fees, brought as a result of my participation in the Event.

No Guarantee of Safety: I UNDERSTAND THAT PARTICIPATION AT THE ICE PALACE IS AT MY OWN RISK AND THAT THE ICE PALACE MAKES NO GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING SAFETY.

Medical Treatment: I consent to receive medical treatment which may be deemed advisable in the event of injury, accident or illness during the Event. This release extends to any liability, including medical and transportation expenses, arising out of or in any way connected with such medical treatment or transportation.

Photography Release: I grant permission to the Event organizers and their designees to take and use photographs, video recordings, or other images of me in connection with the Event for any lawful purpose, including but not limited to publicity, marketing, and web content. I waive any right of privacy, publicity, compensation, copyright or other rights to said images and releases the Event organizers and their designees from any claims or liability relating to the use of said images.

Compliance with Rules: I agree to comply with all rules, regulations, and instructions of the Event organizers. Failure to do so may result in immediate removal from the Event.

Severability: If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law: This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Minnesota. Any legal action relating to this Waiver and Release shall be commenced exclusively in the state or federal courts located in Minnesota.

Acknowledgment: Participant acknowledges that he/she has read this Waiver and Release, understands its terms, and signs it freely and voluntarily without any inducement.

For participants under 18 years of age: A parent or legal guardian must sign this Waiver and Release on behalf of the minor participant. The undersigned parent or legal guardian hereby: (a) Consents to the minor’s participation in the Event; (b) Agrees to all provisions of this Waiver and Release on behalf of the minor; (c) Agrees to assume all risks and responsibilities for any damages or injuries the minor may sustain; (d) Releases the Released Parties from liability for the minor’s participation as set forth in above.
